Terms & Conditions

1. Terms of Acceptance
By booking any service with Samara Wave and CV Samara Wisata, you acknowledge and agree to these Terms and Conditions. Please review them thoroughly prior to making a reservation.

2. Definitions

  • Client means the person or an organization who makes the booking or bought the service;

  • Participant or Participants means the participants in the Service as enrolled by the Client on whose behalf the Client hereby enters into this Contract and for whose actions and errors the Client is fully and solely responsible for;

  • Party or Parties means individually either Samara Wave or Client and Participants or collectively refers to all together;

  • You means the Client or Participants;

  • We, Us or Our means Samara Wave and CV Samara Wisata;

  • Service means the bookable service or services offered by Samara Wave on its platform;

  • Booking Form means the online or offline booking form submitted by the Client for the Participants’ enrollment into the Service;

  • Party or Parties means individually either Samara Wave or Client and Participants or collectively refers to all together;

  • USD or US$ means the United States Dollars.


3. Bookings

Samara Wave is a female-focused surf and travel company. By booking any service with Samara Wave, you acknowledge that:

  • The Client making a booking of a Service is of minimum 18 years of age;

  • The Participant enrolled in the Service is a female;

  • Girls under 18 years of age shall be accompanied by a female legal guardian during the service or have a written consent from the guardian to enrolled in the service;

  • Children 12 years of age and younger should always be accompanied by a legal guardian.


4. Payment
Payment shall be made in USD, in cleared funds without delay, deductions or set-off.

5. Cancellation & Refund
Please refer to our [Refund Policy] if you wish to make a cancellation.

6. Your Responsibilities
You must ensure that the participant are medically and physically fit to participate in surfing and other activities. Compliance with all safety directives from our staff is mandatory. Samara Wave and its partners are not responsible for any participant’s personal injuries, sickness or loss of personal belongings during lesson or retreat.

If you have a pre-existing condition that may affect your physical or mental experience during the Service, or may affect your interaction with other guests or our team, we respectfully ask that you make us aware of this at the time of booking and include it in the booking form. We have the right to assess and decide to accept or decline your booking even though you have made the payment. Your funds will be returned to you in full amount.  

If any pre-exisiting condition is not revealed to us at booking, and later puts yourself, or others, in a situation of not being able to provide adequate care or causing harm to others,  we retain the right to remove you from the Service without providing a refund or credit; forfeiting all payment.

7. Insurance
Travel insurance is mandatory. Participants must have comprehensive travel and medical insurance that includes coverage for water sports and other related activities.

 

8. Photos, Videos and Media coverage

Client and Participants acknowledge and understand that Samara Wave will be taking photos or videos during the lessons and retreats and such photos and videos may be posted on various forms of media and may be used without charge in all media for promotional or marketing purposes.
Please send us an email if you wish not to participate in any form of such media coverage.


9. Changes by Us
We may occasionally need to make changes to the scheduled lesson, itineraries or accommodations due to weather or unforeseen circumstances. We will inform you as soon as possible and provide suitable alternatives.

10. Liability Limitation 
The Client and Participant fully indemnify and hold harmless Samara Wave and CV Samara Wisata against claims for loss or damage to personal property, personal injury, death, and any claim arising from the Participant’s errors, omissions, actions or negligence and from any errors, actions, omissions, claims whatsoever between Client, Participant, other participants, Travel Service Provider or any third party whether related to the Service or not.
Samara Wave and CV Samara Wisata shall not be responsible for any Participant leaving the Service earlier than the completion, or for arriving at the destination earlier/later than announced lesson or retreat, and such risk and cost is at the Client’s and Participant’s sole responsibility.

11. Force Majeur

Samara Wave and CV Samara Wisata shall not be liable for losses, injuries or death occurring directly or indirectly by reason of circumstances beyond its reasonable control, including, without limitation, Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster); action or inaction of civil or military authority; acts of foreign enemies; war; terrorism; riot; insurrection; sabotage; epidemics; labor disputes; civil commotion; or interruption, loss or malfunction of utilities, transportation, computer or communications capabilities.


12. Privacy Policy

13. Governing Law
These terms are governed by the laws of Indonesia and any disputes will be resolved in local jurisdiction.

14. Changes to Terms and Conditions
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.
